Alkalo sued! Court battle between alkalo and businessman over land gets underway

The long awaited trial involving Landing Jadama a businessman and Borry Jasseh Alkali of Old Yundum Village has commenced at the Brikama Magistrates Court.

Landing Jadama filed a lawsuit at the Brikama Magistrates Court to make a declaration that a piece of land measuring 190m by 115m by 50m by 80m by 115m by 235m situated in Old Yundum Village, West Coast Region belongs to him and that the court should compel the defendant Alkalo Jassey to effect the transfer of ownership of the said land in his name.

Appearing in court for the first day on Monday, defendant Borry Jassey, alkali of Old Yundum village had the representation of two state counsels, Sheikh Omar Sibbie and Senior Counsel M.D Mballow.

State counsel Sheikh Omar Sibbie filed his motion before the sitting magistrate stating that the state intends to rely on the 10th paragraph affidavit and on all paragraphs of the affidavit from paragraph two (2) to nine (9).

Taking the motion from Counsel S.O Sibbie, second senior state counsel  M.D. Mballow says the course of action before the court has been stated for it to be moved to the high court, pursuant to statutory rights,in order in which the plaintiff has been relying.

Meanwhile for plaintiff Landing Jadama, he did not have any representation of an attorney and equally as well, currently attending another trial at the high court, which is related to the same land, as he was sued by one Pa Babou Tunkara, concerning the same land situated at Old Yundum Village.

Considering the matter at hand, the sitting magistrate reminded state counsel S.O Sibbie that the matter at hand could be technical at some point as it involves two different courts all hearing over one case.

Landing Jadama who lives in Brufut filed a lawsuit against the alkali of Old Yundum on 17th of February 2021 making claims he obtained a court order from the Brikama magistrate court against the inspector general of police and possession was given to him over a landed property measuring 190m by 115m by 50m by 80m by 115m by 235 situated at Old Yundum.

The plaintiff further stated that he went to the alkali of Old Yundum who goes by the name Borry Jassey, to transfer the said lands to him which he deliberately refused to do, after showing him the entire necessary document from the Brikama Magistrates Court and according to the plaintiff, the alkali of Old Yundum did not give him any reasons as to why he refused to hand over the land to him.

The magistrate adjourned the court hearing until Wednesday 31st of March, 11:00 am.
