Press Release: Presidential /Executive Directives or orders are not Law, contrary to the statement by the Deputy IGP

0

Gambia Bar Association: Press Release

4th November 202

The Gambia Bar Association (GBA) is deeply  concerned and troubled by the statement made by the Deputy Inspector General of Police (DIG) published in the Standard Newspaper dated 2nd November, 2021 captioned – Deputy IGP says executive orders are considered laws. According to the standard newspaper article, Deputy IGP was quoted as follows “Executive order only comes from the president and nobody else. Remember every Gambian votes in for the president and under the constitution  the president has powers and when there are situations that he knows definitely require an executive attention, he has a constitutional mandate to give directives and whatever he says and does is law” . He was further quoted as stating “ An Executive Order is law whether or not it favours anybody. If the President gives directives, it is law and if he writes, it is law ”.

For the record, it is important to categorically state that the  statements ascribed to the DIG in the Standard Newspaper report are not consistent with the 1997 Constitution and the applicable laws of the land. For the benefit of the public, it is important to make it unequivocally clear that Presidential Directives or Executive orders in our jurisdiction do not have the force of law nor are they based on any constitutional authority. The President as the head of the Executive, like the other two arms of Government, can only exercise powers conferred by the Constitution and the applicable laws of the land as set out in the Constitution. Let me take this opportunity to remind the DIG and by extension The Gambia Police Force, that the Constitution is the supreme law of the land in our Republic as provided for in section 4 of the 1997 constitution which  states  “This constitution is the supreme law of The Gambia and any other law found to be inconsistent with any provision of the Constitution shall, to the extent of the inconsistency, be void”. Section 7 of the Constitution sets out the sources of law and 7 (b) in particular states  (b ) Any Orders, Rules, Regulations or other subsidiary legislation made by a person or authority under a power conferred by the Constitution or any other law.

The combined effect of sections 1, 4, and 7 of the Constitution is that a President or any authority or person acting on his behalf can only exercise powers conferred by law. Furthermore, any powers conferred to the executive shall be exercised within the limits set by the Constitution.

The Gambia Police Force is a statutory institution established by section 178 of the Constitution and the Police Act 1950 as amended. Pursuant to section 6 of the Police Act, “the Inspector General of Police shall be command, superintendence and direction of the force”. The law therefore clearly stipulates the command structure of the police and that orders to the police can only emanate from Inspector General of Police as the highest authority in the police command structure. Therefore, the Gambia Police Force as a law enforcement authority established under the Constitution,is legally obliged to exercise its functions strictly within the confines and limits set by the Constitution as well as its governing statute, the Police Act. The Police Force as a rule of law institution  governed by law can and should only carry out lawful orders. Any police officer who follows an executive  directive/order  that is  in violation of the law would be held accountable and not immune from legal responsibility for their actions.

It is rather unfortunate that the second most senior police officer can make such an erroneous statement to trainee police men and women. It is rather unfortunate that the Gambia Police Force has not taken any steps to rectify such a serious  misstatement of the law by a senior member of the force.  It is important that the police leadership proactively ensure that the police force and its members have a clear understanding that they are a national police force serving the citizenry in accordance with the laws of the land. The police as a law enforcement authority should under no circumstances carry out any orders, instructions or directives from the President or any person acting on behalf of the executive if the same is not backed by the force of law. As we forge ahead to build and consolidate our nascent democracy premised on respect for the rule of law and good governance, the police as the guarantors of our peace  and enforcers of the law are  expected to be guided by the laws of the land without fear or favour consistent with democratic norms and values. The erroneous statements emanating from or ascribed to the second most senior Police officer in the country is reminiscent of the type of mindset that enabled the previous regime to use the security services as a tool to oppress and brutalise the citizenry. As we  have transitioned into a vibrant democracy and about to go to the Presidential elections, it is important for the police remain loyal to the constitution and  abide by their oath of office.

I wish to reproduce the oath of office of the Police as a reminder of the sacred duty the police owe to the citizenry. Section 9 of the police act states as follows;

“A superior police officer and a Sub-Inspector shall on appointment take and subscribe the following oath-

I……………………,do swear that I will well and truly serve the Republic of The Gambia in the office of ……………without favour or affection, malice  or ill-will, and that I will cause the Republic’s peace to be kept and preserved ; and that I will prevent, to the utmost of my power of all offences against the same; and that while I shall continue, to hold the said office or some other office in The Gambia Police Force, I will, to the best of my skill and knowledge, discharge all the duties thereof faithfully according to the law – so help me God ”. My emphasis

For the Gambia Our Homeland.

‘Give Essa Faal his Gele Geles’: KLF mocks Essa Faal after drivers turned their backs on him for NPP

0

Kebba Lang Fofana was mean to Essa Faal on Thursday evening when he wrote that the Turnaround leader should now be given his ‘gele gele’ vans.

Mr Faal filed in his nomination on Thursday morning but his big event didn’t go as planned as his supporters could not accompany him to IEC.

A livid Essa Faal charged that the 200 ‘gele gele’ vans he had a deal with refused to convey his supporters after entering into a better deal with NPP. He also said the fuel dealers were selling fuel only to drivers on NPP nomination mission.

Mr Faal told reporters that it was the worst political sabotage in the political history of the country.

But NPP stalwart Kebba Lang Fofana wrote Thursday evening after everything was all over: “Please TURN AROUND and give Esaa Faal his Gele Geles.”

But one UDP supporter Alieu Sanneh wrote: “Following the teachings  and preachings of lawyer Ousainou ANM Darboe. UDP and NPP are not enemies but opponents. We are each others keepers.

“The UDP supporters are following this preaching always. Due to shortage of fuel and vehicles, UDP pickup Driver decided to give them free transportation. See it for yourself.”

By Lamin Njie, Editor-In-Chief

The National People’s Party has responded strongly to UDP in terms of crowd by producing a never-before-seen crowd during President Barrow’s nomination on Thursday.

One person reacted: “Wow beyond massive. The UDP pretenders shall be buried.”

President Barrow took his turn to file his nomination papers for president Thursday morning accompanied by an unprecedented crowd – but also his two wives, government officials and NPP coalition partners.

Ebrima Sillah Information Minister told The Fatu Network: “We’re extremely very happy today, having come in large numbers. Tens of thousands of NPP supporters have come out to show solidarity, and to come and nominate their presidential candidate, His Excellency President Adama Barrow who is going to win with landslide in this election on the 4th of December.

“We have presented more than a 100,000 nomination forms to the Independent Electoral Commission. That shows the power that the NPP has come with today.”

“We’re happy. Despite the challenge of fuel scarcity, people have come, you have seen the crowd. You have seen it. The ones you have not yet seen are going to Buffer Zone,” Ahmad Gitteh said.

‘I’m going to be honest’: Halifa Sallah speaks strongly that he has reached peak of his participation in Gambian politics

0

PDOIS leader Halifa Sallah has dropped a huge hint that he will bow out regarding Gambian politics, telling reporters he has reached the pinnacle.

Mr Sallah is the country’s most experienced political leader contesting the December presidential election. He has not achieved much in terms of votes in past elections.

He however warned on Wednesday that he was on his way out of Gambian political process.

Mr Sallah said: “I have reached the pinnacle of my participation in your political process. I am going to be honest, I am going to be direct and I am going to help you to know that this is the final battle of ideas.”

The veteran politician filed his nomination papers with the IEC on Wednesday, in a crowded race of over two dozen candidates.

‘Even God changes his mind’: Sheikh Tijan Hydara speaks on break up of his short-lived alliance with Jammeh’s supporters

0

GANU leader Sheikh Tijan Hydara has addressed the issue of his short-lived alliance with former President Jammeh’s supporters.

Mr Hydara’s political fortune boomed but only briefly after Jammeh changed his mind regarding his supporters backing Mr Hydara.

Speaking exclusively to The Fatu Network, Hydara said he is not bothered by the break up of the alliance as it could be God who changed his mind.

He said: “Even God changes his mind, what is the problem? You said I said in the rally that it’s God that destined the alliance with APRC. What about if God changes his mind, if God decides that that is not the best for me.”

I Have Brought Development to This Nation, and I Will Continue in That Direction’- President Adama Barrow

0

The President of The Gambia and Presidential Candidate of the National People’s Party (NPP) Adama Barrow has said that he is a democrat and he believes in the principles of democracy and the rule of law, indicating that he has been in office for five years and has brought development to this nation, promising to continue in that direction.

President Barrow was speaking after successfully presenting his nomination papers to the Independent Electoral Commission (IEC) at Election House

He started his address to the media by extending his condolence to the bereaved family of party supporters who died yesterday as they made their way to the nomination venue at Election House.

“I am a democrat and I believe in the principles of democracy and the rule of law. I have been in office for five years and I have brought development to this nation, and I will continue in that direction,” President Barrow said.

He further noted that where there is no infrastructure there is no development. Therefore, he will continue his infrastructural development.

“I have already fulfilled all requirements, we play by rules and regulations and it is now left with the IEC to do their job,” President Barrow said.

He maintained that they (NPP) are in alliance with the APRC in the best interest of the country, national security and development.

He went on to advise the IEC to be independent. “You are the referee, and you must be independent, and it makes the job easy for the players and it makes it easy for all the players to accept the results”.

Adama Barrow was born in Mankamang Kunda, a village near Basse Santa Su on 15 February 1965 and is the third and current President of The Gambia. He attended Crab Island Secondary School and the Muslim High School.

Barrow was then chosen as the UDP candidate in the 2016 presidential election. It was later announced that he would stand as an independent with the backing of the opposition group Coalition 2016 (a coalition supported by the UDP and six other parties).

Barrow won the 2016 presidential election with 43.34% of the vote, defeating long-time incumbent Yahya Jammeh. Jammeh initially accepted the result, but later reneged on this, and Barrow was forced to flee to neighbouring Senegal. He was inaugurated at the Gambian embassy in Senegal on 19 January 2017, and Jammeh was forced to leave the Gambia and go into exile on 21 January. Barrow returned to The Gambia on 26 January.

‘This is the worst political sabotage’: Livid Essa Faal spends the entire time complaining that NPP sabotaged his nomination

0

Essa Faal has filed in his nomination credentials but it will be remembered for the lawyer going on an extraordinary tantrum.

Mr Faal arrived at the IEC at 9am today but he was visibly upset that he did not come with his crowd due to what he called political sabotage.

“This is the worst political sabotage that has happened in Gambian political history as far as I know it. You see, we can be opponents in the political field but we should also be gentlemenand women. So to behave in such criminal conduct really is… Is conduct not befitting any government official in any country,” Mr Faal alleged.

According to Mr Faal, they hired 200 gele gele vans only for their deal with fuel dealers to be scuppered by NPP. The drivers allegedly changed their mind after the NPP offered them a better deal.

Mr Faal said: “Otherwise today Gambians will see. But they cannot stop this, this has taken root in people’s hearts already. I am more determined today. I am more confident today and my trust in Gambian youth can never be shaken. They know what is going on. See how happy they are.”

‘Youth Empowerment is Fundamental to Change The Gambia’- Essa M. Faal

0

One of the Independent candidates in the 2021 Gambian presidential election Essa M. Faal has said that youth empowerment is fundamental to change The Gambia.

He was speaking immediately after presenting his nomination documents to the Independent Electoral Commission (IEC) at Election House.

“Today is historic for several reasons, the young men and women are speaking loudly they want change. Everywhere in the country people are shouting that they want change and are expressing their distrust for this government,” Essa M. Faal said.

He further alleged that the NPP of President Adama Barrow sabotaged their nomination by paying double for the vehicles they had already paid for.

“I have never seen such low play in politics of this country, I never thought I would witness a day in which democracy will be circled by a very unpopular government. Come December 4 we will  change that.

He noted that youth empowerment among several other things is fundamental to changing The Gambia complaining that doing business in The Gambia is becoming more difficult as the years go by.

“If The Gambia continues in this direction many Gambian’s will continue to invest abroad. I want to make this country a safe and competitive place,” Faal said.

Commenting on accusations that he holds a Senegalese Citizenship he said,

“That is the most nonsensical accusation, that I have dual citizenship. What can a Senegalese citizenship do for me that a Gambian citizenship cannot do for me? If I had I would have renounced it,” Faal said angrily.

Essa Faal was born on the 13th of March 1966 in Banjul. He has extensive knowledge and experience in international criminal law and international human rights law.

He started his legal career as a State Counsel at the Ministry of Justice in The Gambia in 1994 and during this period he served as Counsel to the Commission of Inquiry into the Financial Activities of Public Corporations.

He has worked for the International Criminal Court (ICC) serving as Counsel for Charles Ghankay Taylor (former President of Liberia) before the Residual Special Court for Sierra Leone and Counsel for Saif Al Islam Gaddafi at the ICC.

In September 2018 soon after the establishment of the Gambia truth commission, Essa Faal was appointed lead counsel, a job he just completed after three years of probing and bringing to light, the true extent of the 22- year reign of terror of former president Yahya Jammeh.

We all Contributed to Creating This Problem, So We Must Work Together to Change the Situation -Tamsir Jasseh

0

One of the candidates for the presidency of The Gambia Tamsir Jasseh has called on all Gambians to work together to solve the country’s problems since every Gambian has in one way or the other contributed to creating the problem

He was speaking after his nomination process at the Independent Electoral Commission (IEC)

“We all contributed to creating this problem so we must work together to change this situation. We must get the change that we voted for. There is nothing in this nation but hopelessness, poverty and disease, but we have a lot of potential in the youth. We need a leader that will come forward and harness this potential,” Tamsir Jasseh said.

He further noted that his party is willing to look beyond tribe or religion and implement the law as it is in the country’s law books. He revealed that there is a lot of poverty in The Gambia because the people are corrupt

But how does he intend to fight corruption?  He said the laws must be enforced and those who violate the laws must be held accountable. Speaking about his citizenship status he confirmed that he does have American citizenship but the process of dropping it has begun.

Tamsir Jasseh is the first Gambian presidential candidate to possess dual citizenship in the Gambia and the United States of America. He is also the first Gambian war veteran to seek the office of the president of the Republic of the Gambia. He served in the United Nations Navy and was a veteran of the first Gulf War (Operation Desert Storm) and the first Gambian to serve as policy adviser for the Gambia Police Force.

He served as deputy inspector general of the Gambia Police Force, and director-general of the Gambia Immigration Department. He holds a Master of Science degree in terrorism and homeland security, a Bachelor of Science in criminal justice, and a graduate certificate in public administration, and a second graduate certificate in justice studies.

Photographer comes to Sheikh Tijan Hydara’s rescue as IEC rejects his dollars

0

A photographer proved helpful to Sheikh Tijang Hydara on Wednesday when he gave the GANU leader D10,000 in exchange for the politician’s rejected 200 dollars.

Mr Hydara filed his nomination papers at the IEC on Wednesday but he showed at the IEC with insufficient dalasi cash.

Mr Hydara had dollars on him but his dollars were turned down by officials of Election House when he wanted to use it to settle his D10,000 deposit.

The politician dismissed the issue when asked by reporters saying he came with Gambian dalasi but it was simply not enough and that he thought he could use his dollars instead.

During the moment of mild drama, a photographer accepted to take the politician’s 200 dollars in exchange for his D10,000 which Mr Hydara ended up giving to IEC officials.

LAMIN NJIE – OPINION: Crowd is the most important thing in this election… Any leader who says it’s not has just given in even before the race could start

The also-rans in this election is becoming clear. It’s only a matter of time before they’re honest with themselves and coming out to tell citizens they do not have what it takes to compete in this heavyweight contest. It’s also only a matter of time before we learn the handful of contenders in a race that would go down in history as initially boasting of 26 candidates.

Nomination for president is underway with 18 candidates so far presenting their certificates and IDs to officials of the Independent Electoral Commission for vetting. The problem is some have already started conceding even before the race could even start.

I have been at Election House every day since nomination began on Saturday and I can tell you some of these leaders are in this for the buzz. Coming to present your nomination papers with just your taxi driver or five supporters is scandalous. And that’s me being kind.

UDP did well on Monday in terms of crowd. They showed they mean business in terms of the number of people I have seen. Crowd is what makes one win an election. And no wonder Mr Darboe confidently declared that change is coming.

It’s laughable and ridiculous for a leader to dismiss the role of crowd in this election. I repeat: crowd is what makes one win an election. Any leader who says otherwise is fooling no one but himself.

So far, it’s UDP who have made a strong statement intent. President Barrow will be at the IEC on Thursday. He will be looking to answer UDP in kind. This election is surely not for the unpopular and the supporter-less.

OPINION EDITORIAL: A Competition of Ideas

0

By R. Carl Paschall, U.S. Ambassador to The Gambia

For the first time in more than a generation, Gambians are presented with an intimidation-free election, having embraced the democratic freedoms ushered in after they courageously cast their marbles in December 2016 to demand peacefully at the ballot box a break with the past. Even a casual observer can’t miss the energy and excitement – and, yes, tension – with a crowded political field of candidates vying to make their case to the voters of why theirs are the best ideas to move The Gambia forward in rule of law-based democratic governance, respecting citizen’s fundamental freedoms and human rights, and spurring economic growth and security.

Indeed, this is and must be a competition of ideas – and not a war of words. Candidates are busily presenting their platforms, considering political alliances, and appealing for votes. Importantly, all have called for a peaceful electoral period that permits a free people to exercise their rights and responsibilities without fear or intimidation during the pre-election debate as well as when they cast their vote on 4th December. All the speeches, the rallies, and political debates –all the energy Gambians are showing for the democratic process – reinforce the world’sunderstanding that Gambians charted a new course in December 2016 towards reinforcingdemocratic governance, and that they are passionate about it.

Of course, elections can sometimes go off course. In 2016, we saw those in power attempt to throw the vote away. It took the strong will of the Gambian people – and the tremendous moral courage of many in government who refused to subvert the will of their fellow Gambians – to pursue a different path, even when faced with intimidation. Ultimately, the desire to chart a new course, to create and sustain a democratic process prevailed. History was made, and the world recognized the Gambians’ passion for freedom – and achieving it peacefully.

The democratic gains forged by the Gambian people in 2016 and the fierce determination Gambians have shown over the past five years to continue charting this new course forward to transparent, equitable, rule-of-law based democratic governance accountable to the people is an inspiration to democratically-minded people the world over. For this reason, the U.S. Embassy is working in coordination with international partners to support Gambian electoral processes, both those of the government and of civil society, including in fielding monitoring teams country-wide to observe the election process. We expect to find – as we did when we monitored the voter registration process – a credible process and an election in which all registered Gambian voters can freely and without intimidation make their voices heard by casting their marble for their preferred candidate. We will also have people working in the embassy, following the new and social media reports, and consulting with international and domestic observers. And Washington is following very closely as well.

We join with the Inter-Party Committee, the registered political parties and independent candidates, and the voices of so many Gambians from all walks of life in encouraging a vigorous and most of all peaceful competition of ideas and casting of marbles. We urge a healthy dose of considered analysis of the many rumors and mistruths that will undoubtedly continue to circulate on social media.

Madi Jobarteh boldly declares Darboe is the most ‘de-tribalised’ leader

0

Commentator and activist Madi Jobarteh has declared UDP leader Ousainou Darboe is the most de-tribalised leader in his life.

“Of all our political leaders Ousainou Darboe is the most de-tribalised leader in his life, and UDP is the most inclusive party.

“Check the life of each leader and check the leadership and membership of each party for evidence. Just stating facts,” Mr Jobarteh wrote on his Facebook on Wednesday.

UDP and leader Darboe has often been accused of being a Mandinka party and with a Mandinka agenda.

Mr Darboe has always insisted UDP isn’t a Mandinka party and has even presented the issue of him marrying women from the Wollof tribe in a bid to drive away that charge.

GDC Must be Aware of its Responsibilities

By Madi Jobarteh

Following its nomination today, GDC went ahead to hold a rally at Buffer Zone in Talinding where they gave the Tinpot Dictator Yaya Jammeh the platform to address the gathering. In his address, Yaya Jammeh spared no effort but to spew once again dangerous tribal remarks intended to generate hatred between the Mandinka and the rest of the Gambian population. Through disinformation, Yaya Jammeh embarked on discriminatory, hate and dangerous speech intended to alienate Gambians from one another.

The Gambia Democratic Congress and its presidential candidate Mamma Kandeh must realise that they owe an obligation to the Gambia and the Constitution to maintain national unity, cohesion and peace. Hence GDC must realise that it is failing itself, not to even mention the Gambia when they give space to a disgraced tyrant to spread hate and discrimination in our society. Yaya Jammeh’s only wish is to see a failed and broken Gambia so that he can vindicate himself. But should GDC allow itself to be used as the weapon of a disgraced tyrant?

It is obvious to any sensible person that Yaya Jammeh is a failed tyrant who is a disgrace to the Gambia and the rest of the world. Having failed in his 22 years of misrule, Yaya has nothing left but to seek ways and means of circumventing justice and accountability by any means. This is why he is seeking every possible way to destabilise and divide the Gambia so that he can prevent or delay his day of reckoning.

Gambians cannot forget the pain and misery of Yaya Jammeh’s misrule which was characterised by rapes, tortures, disappearances and killings. In 22 years, Jammeh indebted and impoverished the Gambia as never seen before while plundering public wealth and personalising state institutions for his selfish interest.

But today, Yaya Jammeh is trying to hang onto a small community of desperate supporters most of who were even his direct victims or families of his victims. These are people who generally lack political awareness or are consumed by Yaya’s tribal bigotry and false narratives such that they are fooled to believe that they owe him anything! But should GDC and Mamma Kandeh bring itself so low or allow to be fooled? Should the desire for winning the presidency make Mamma Kandeh abandon his obligation to the Gambian nation?

GDC and Mamma Kandeh must be told to pursue only noble and honourable means to gain the mandate of Gambians rather going through a party and a man who are known for only misrule and atrocities. GDC must remember that the people had given their mandate to Yaya Jammeh and APRC on four consecutive times in this country and all throughout that period, Yaya did not only betray the country but also went further to destroy the rights and lives of the people with impunity.

Therefore, why would GDC and Mamma Kandeh pretend to forget or ignore our most recent difficult past only to entertain a man whose victims are also among the very supporters of GDC?

The Gambia Government, IEC and the Inter-Party Committee must tell GDC and Mamma Kandeh that they would be held responsible if Yaya Jammeh succeeds in fomenting tribal war in this country. All Gambians must tell GDC that their decision to embrace Yaya Jammeh is unpatriotic, dishonest and irresponsible and they must be held accountable if Yaya Jammeh sets this country on fire.
